All users of the Website, hereafter referred to as User or Users, must read these online terms of use, hereafter referred to as Agreement, before using the Website. You and your when used in this Agreement includes any person who accesses the Website and submits personal data. By accessing this Website and any of its pages and continuing to use this Website, you as User of the Website are agreeing to be abide by the terms and conditions set out below in this Agreement and our Privacy Policy.

If a User does not accept either or both of this Agreement and the Privacy Policy, please do not use this Website. TDG reserves the right, at its own discretion, to revise, amend or modify this Agreement and the Privacy Policy at any time without prior notice, as well as to discontinue temporarily or permanently the Website, or any part thereof, with or without notice to you. TDG will not be liable for any kind of loss or damages caused to any User, be it direct, indirect or consequential, and including but not limited to any loss of revenues, profits, business or data, in any way related to the Website, or for any claim, loss or injury based on any errors, omissions, interruptions or other inaccuracies in the Website, or any other loss or damage of any kind however arising and whether caused by tort, including negligence, breach of contract or otherwise, even if foreseeable, incurred by any person for any cause arising as a result of the use of or access to, or inability to use or access the Website, any use of or access to, or any inability to use or access any web sites linked to the Website or linked to from the Website, any transactions via the Website or any content posted on such Website, including any defamatory content or content which infringes intellectual property rights of any third party.

This does not affect TDG’s liability for any fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under any applicable law.

TDG and its affiliates, agents, licensors or other third-party service providers are not liable for any direct, indirect or consequential loss or damage caused to any User attributable to such destructive features. 6. TDG has no authority to act for any third-party, unless otherwise agreed between TDG and the third-party, including but not limited to any User of the Website. As User of the Website you agree that TDG will have no liability to you in relation to any dispute, payment or contract between you and any such third party.

7. Specific Uses – Users applying for Apprenticeship Program via the Website

Users of the Website may submit application for the Apprenticeship Program hereafter referred to as Program, i.e. to make application for being apprentice of a specific master featured on the Website. These Users agree that any personal data received via the Website or from TDG shall only be used for the purpose of the Program, including but not limited to identifying the applying User, screening the candidates and provision of such personal data to the specific master for his/her consideration. Any personal data received which are irrelevant to the above purposes shall be disregarded and shall not be saved, stored, collected, processed, used, distributed, published, disclosed or transmitted in any way, including but not limited to for any commercial purpose. The Users also agree that any personal data collected via the Website or from TDG shall be promptly and properly deleted when the above purposes have lapsed or been achieved, unless otherwise agreed by the User and TDG.

All Users accept that all personal data, information or materials provided by them publicly on the Website are voluntarily provided and are given entirely at their own risk. The Company shall not bear the responsibility of protecting the personal data, information or materials so provided publicly therein.

8. Intellectual Property Rights

All contents of the Website, including without limitation the text, images, information, comments, layout, database, graphics, photos, pictures, sounds or audio formats, videos, software, brands and HTML are the intellectual properties of the TDG, the featured masters or the Users, as the case may be, which are protected by applicable copyright and trademark laws and may not be downloaded, copied, modified, reproduced, printed or distributed in any way except that Users may download and/or print a copy of such materials for their own legal and non-commercial uses or for such purposes as permitted under the terms and conditions of any agreements entered into between TDG and the Users or between the featured masters and the Users. Any use of any of such content other than those permitted under the Agreement and the terms and conditions of any other agreements entered into between TDG and the Users and/or between the featured masters and the Users is strictly prohibited and the TDG reserves all its rights in this respect. Users acknowledge that they will be solely responsible for any adverse consequences arising from their breach of copyright laws and/or other intellectual property laws.

 

9. General information about the Website
1. This Agreement is governed by Hong Kong law and Hong Kong Courts will have exclusive jurisdiction over any claim arising from, or in connection with any use of the Website.
2. Unless otherwise agreed by writing between any individual User with TDG, this Agreement, including the Privacy Policy, constitute the entire agreement between you as User and TDG and governs your use of the Website, superseding any prior agreements between you and TDG in respect of the Website.
3. The failure of TDG to exercise or enforce any right or provision of this Agreement does not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid or void, the parties agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and the other provisions of this Agreement shall remain in full force and effect.
4. Unless agreed by TDG in writing, no User should make use of any materials, content and information on the Website.
5. All User agree that he/she/it shall only use the Website for lawful purposes.
6.
